Elder Law & Estate Planning

 

Estate planning is essential for every husband, wife, mother, father, grandparent, business owner, professional, or anyone else who is concerned about providing responsibly for their own well being during their lifetime and for the well being of those they love, and for anyone who seeks to make a difference in the lives of others after they're gone. Estate planning is not "death planning"; rather, it is "life planning," and an essential and rewarding process for individuals and families who engage in it on a serious level.

 

 

Guardianships & Conservatorships

Mental capacity and undue influence is a concern when disabled individuals are in a position to be taken advantage of by unscrupulous relatives, neighbors, or health care workers in nursing homes. We work closely with clients in preparing paperwork, documentation, and medical examinations necessary when petitioning the court to create a conservatorship or guardianship. Once a conservatorship or guardianship is granted, our office continues to work with the estate's ward since federal law requires them to file an annual financial account of the estate.

 

Medicaid & Disability

 

The cost of health care and long-term care is skyrocketing. Many Michigan seniors find that they must rely on Medicaid to pay for their long-term care or nursing home costs (which can exceed $7,000 per month). Unfortunately, many Michigan families facing these exorbitant costs are receiving poor advice from their neighbors, friends, or family. Through proper planning, many of your hard-earned assets can be shielded from the nursing home's grasp, despite what social workers, nursing home intake staff and other well-meaning professionals may tell you. We will also assist you in implementing a plan that protects your assets for your loved ones, avoids the tentacles of the state’s “estate recovery” law, and gets you or your loved one the nursing home care they deserve and need.

 

Veteran's Affairs

Millions of veterans and their families are eligible for Veterans Benefits but do not take advantage of them. Consider that for a moment. Our nation’s greatest heroes, who have sacrificed so much in defense of our country, not receiving the benefits to which they are entitled. This sad situation is the result of confusion over the benefits available, eligibility requirements, and the complexity of the application process itself.

Attorney Geoff Malicoat is experienced in assisting veterans and their surviving spouses in qualifying for the Aid & Attendance VA Benefit that can pay over $2,000 per month.

Probate Practice

Probate is the process of passing the assets of a deceased person to his or heirs. In addition to the grief that is caused by the loss of a loved one, the personal representative of an estate is required to quickly learn the legal procedures necessary to ensure a smooth estate administration. We will provide the help and assistance necessary to ensure a successful probate administration.
